Yikes! Some bad news if you’re Pastor Timothy Omotoso: The High Court in Gqeberha has dismissed his application to have a mistrial decalred on Monday morning, 6 December 2021.

The flamboyant 61-year-old and his two female co-accused — Lusanda Sulani, 36, and Zukiswa Sitho, 28,  face 97 charges, including human trafficking, rape, sexual assault and racketeering. Sulani and Sitho are accused of recruiting young women for the purposes of sexual exploitation by Omotoso.

The pair is currently out on R10 000 bail each.

BID TO HAVE OMOTOSO JUDGE RECUSED IS DISMISSED

In addition, the court also denied Timothy Omotoso’s application to have presiding Judge Irma Schoeman recuse herself, however that bid has also been dismissed.

The defence had applied for a mistrial to be ruled after allegations that the state mislead the court and that prosecutors had colluded to alter witness evidence.

State advocate Chris Mouton had asked the judge to dismiss the application. Moutin had stated that none of the evidence brought forward by the defence warrants a mistrial.

Omotoso’s lawyer Peter Daubermaan had told the court that he rape charges against Omotoso do not stand, arguing that it is not warranted when compared to the witnesses statements. He said there is no evidence pointing to penile penetration in the statements.

“Mr Daubermaan had the opportunity to cross examine the witness and can further cross examine her after the trial recommences. He can also apply to recall other witnesses, if he wishes. Under those circumstances, the irregularities did not lead to an injustice that must be decided at this stage. The door remains open, if all the evidence is considered, to find that the accused did not have a fair trial. But it is not an issue that must be decided at this stage… The application for the declaration of a mistrial is dismissed and the alternative remedy that I should recuse myself is also dismissed

The matter has been remanded until the 25 January 2022.
